Abstract: El presente Trabajo de Suficiencia Profesional se basa en la sentencia emitida por el Tribunal Constitucional en el Expediente N° 576-2019-AA. Dicha sentencia resuelve la demanda de acción de amparo presentada por el señor Emiliano Guerra Atau, en la cual él solicitó la anulación de la Resolución del Consejo Universitario 849-2016-UNSCH-CU, fallo que determinó su cese como profesor en la Universidad Nacional San Cristóbal de Huamanga debido a la razón de alcanzar el límite de edad, en cumplimiento del artículo 84° de la Ley N° 30220, también conocida como la Ley Universitaria. El argumento central de la solicitud del señor Guerra Atau se basa en la supuesta vulneración de sus derechos constitucionales, tales como el derecho al trabajo y al debido procedimiento. No obstante, durante el proceso de análisis del Tribunal Constitucional se identificaron diversos derechos vulnerados, en cuanto al presente caso. Dentro de estos se mencionan nuevamente el derecho al trabajo y debido proceso; sin embargo, agregan el derecho a la dignidad y trato preferente.
Para el desarrollo del presente informe, se han empleado fuentes bibliográficas y artículos académicos especializados en la materia. Mediante estos recursos hemos reforzado nuestra posición en cuanto a la decisión de declarar improcedente en parte la demanda, debido a que la vía idónea para salvaguardar los derechos del señor Guerra Atau, era la vía ordinaria de Procedimiento Contencioso Administrativo, siendo el Proceso Constitucional de Amparo una vía residual.
This Professional Sufficiency Paper is based on the judgment issued by the Constitutional Court in Case No. 576-2019-AA. Said judgment resolves the amparo lawsuit filed by Mr. Emiliano Guerra Atau, in which he requested the annulment of University Council Resolution 849-2016-UNSCH-CU, a ruling that determined his termination as a professor at the National San Cristóbal University of Huamanga due to the reason of reaching the age limit, in compliance with Article 84° of Law No. 30220, also known as the University Law. The main argument of Mr. Guerra Atau's request is based on the alleged violation of his constitutional rights, such as the right to work and due process. However, during the process of analysis by the Constitutional Court, several rights were identified as violated in this case. Among these are mentioned again the right to work and due process; however, they add the right to dignity and preferential treatment. For the development of this report, we have used bibliographic sources and academic articles specialized in the matter. By means of these resources we have reinforced our position regarding the decision to declare the lawsuit inadmissible in part, due to the fact that the appropriate way to safeguard the rights of Mr. Guerra Atau was the ordinary way of Administrative Contentious Proceedings, being the Protective Action a residual way.
