The present research work deals with the ruling of File No. 02970-2019-PHC/TC, developed ultimately by the Constitutional Court, which arises as a result of the denial by the National Registry of Identification and Civil Status (RENIEC) in obtaining the National Identity Document (DNI) of the citizen Jhoana Rudas Guedes, since the maternal surname cannot be put before the paternal surname, despite there being a birth certificate that records the appellant's surnames in that order. Given this controversy, the ruling of the Constitutional Court fundamentally transcends our legal system, by establishing that the interpretation of article 20 of the Civil Code must be in accordance with the Political Constitution of Peru, in order to grant men and women equal treatment. and the possibility of deciding on the order of priority of the surnames that will be assigned to the child. Therefore, the purpose of this work is to analyze the statement of the highest interpreter of the Constitution regarding the violation of the right to identity and the right - principle to equality and non-discrimination based on sex, as well as comparative legislation. , the different positions of the magistrates, and the ruling in favor of the appellant, in which he urges the Congress of the Republic to modify and implement in article 20 of the Civil Code, a solution mechanism in case of parental disagreement when determining the order of the son's surnames.
