The right to a pension is recognized as a fundamental and constitutional right, according to article 11 of the Political Constitution of Peru and the diverse jurisprudence that deals with the matter. This right can be elucidated through the Amparo Action process, only in exceptional cases, such as; when the insured has a serious state of health or is very old. This, due to the urgent nature of the Amparo; and in order to avoid irreparable consequences. Now, the main objective of this investigation is to analyze the overruling carried out by the Constitutional Court when issuing new guidelines established in the binding precedent issued in Sentence 313/2023 of Exp N°05134-2022-PA/TC-JUNÍN-OSORES DÁVILA, and they, could generate legal uncertainty for insurers and the ONP, if these entities do not confront them. In the first chapter, we frame the summary of the file, as well as the substantial rules regarding medical evaluations, medical certificates and reports and the accredited entities for such cases. In the second chapter, we focus on describing the most important conceptual bases used in the Judgment. Finally, in the third chapter, we seek to verify the inefficiency of the Disability Qualifying Medical Commissions of both the MINSA and EsSalud, because, as we will develop in said chapter, none of said entities would have adequate CMCI to determine the degree of impairment and much less to issue certificates that corroborate disability due to occupational diseases or work accidents.
