In the professional sufficiency work, a cassation ruling will be analyzed referring to a lawsuit challenging paternity under article 399 of the Civil Code by the person who initially recognized paternity. In this context, the first and second instances declared the claim inadmissible due to legal impossibility and lack of legitimacy to act, respectively; However, the Supreme Court considered that the claim was based on the right to identity, so a new ruling was ordered to be issued. Thus, the research topic is to establish the relationship between the right to effective jurisdictional protection in challenging paternity by people who recognize paternity affiliation and respect for the right to identity of minors. For this purpose, the doctrine and jurisprudence of the Supreme Court and the Constitutional Court were used, considering the international, constitutional and legal framework (International Conventions). Finally, considering the information obtained, the conclusion is proposed that the challenge of paternity under article 399 of the Civil Code could initially be considered that it does not grant legitimacy to act actively to the father who recognizes paternity; However, this rule must be interpreted in harmony with the right to effective jurisdictional protection and the right to the identity of the minor, which would allow the judge to process the claim and, when analyzing the claim, protect the interests of the child minor.
