Through this work, the relationship between pregnancy and military education and training are developed, seeking that both can coexist in the same environment without affecting the rights of the person with these conditions. For this, the case file No. 00374-2017-PA/TC is analyzed. Furthermore, books related to the pregnancy process and its effects on women, scientific articles on Constitutional Law, bachelor's research that cover a point of view related to the topic raised were consulted; as well as national and outside legislation. This investigation showed that by removing pregnant students from military education training, their constitutional rights are being violated, such as the Right to Education, the Right of Equality and the Right to Personal Identity. However, if the student was allowed to continue with her military education and training in their state, there was a high possibility of risking the development of her future baby, violating its rights too. After having carried out the respective investigation, it is concluded that, in this situation, not only the rights of the pregnant student are violated, but also the rights of the future baby. For this reason, it is recommended to incorporate the figure of “temporary suspension due to pregnancy” within the Internal Regulations of the Training Centers of the Armed Forces.
