Through this work, we aim to conduct an analysis of the provisions set forth in the Fourth Civil Plenary Session, Casación N° 2195-2011-Ucayali, concerning the configuration of precarious possession in cases of the termination of the enabling title through extrajudicial contract termination. To achieve this, we will examine the facts surrounding the reviewed cassation, as well as the legal analysis conducted by the judges who considered it. Additionally, we will define concepts that are crucial for comprehending the progress of this work. Finally, we will present our disagreement with the approach prescribed by the Supreme Court for cases involving configurations of precarious possession resulting from extrajudicial contract termination. In this last analysis, we will address the negative consequences that may arise from the Court's approach and analyze the notarial eviction procedure. We will conclude by presenting our proposal to solve these consequences and protect the rights of the plaintiffs in these types of proceedings.
