The purpose of the case study is to analyze and interpret the process carried out and the situation of the procedural subjects, since the interpretation of article 843 of the Civil Code on the origin or not of the division and partition and the action is discussed. of the jurisdictional bodies that declared the claim inadmissible, going against the Pro actione principle and paragraph 3 of article 139 of the Political Constitution of the State. The case that is being disclosed by the plaintiff seeks the division and partition of real estate to which he has a legitimate right because it was an inheritance left by his father to him and the defendants who have exclusive use of the property that is the subject of litigation. The Pro actione Principle allows the A quo to make a decision to admit the claim or conclude the process, in cases where reasonable uncertainty arises. In this research, for a better understanding, bibliographic references from the UPC repository have been used, which have allowed us to understand the process in a comprehensive manner. Given the above, the following questions arise: What motivated the first two instances to declare the claim inadmissible without considering the plaintiff's main claim? Was due process violated or not? The following analysis is intended to answer these questions and state our position on the case.
