This work of professional sufficiency seeks to address the most relevant aspects related to Resolution No. 0030-2022/SBN-ORPE and, in a leading manner, to the binding precedent established in the twenty-fifth recital of the Resolution in question, which states that: “the suitable title to support a donation of real estate granted by a peasant or native community is the public deed and not only the minutes of the general assembly issued by the respective peasant or native community“. In view of this, it is necessary to point out that the present work will start from the normative analysis related to the Law of Rural Communities, the Civil Code of 1984, and Supreme Decree N°008-2021-VIVIENDA. Under these premises, this work will analyze the conceptual bases related to the present research topic to establish the relevant concepts with respect to the problem identified in the Resolution under analysis. In this way, from the analysis of the fundamentals of the case and the theoretical bases established in this work, a better understanding of the Resolution will be achieved, so that the importance of the decision taken for the binding precedent can be satisfactorily determined and our opinion and position with respect to the decision established can be given. Finally, a critical analysis of the importance of the public deed for the donation as a suitable means for the opposition to the legal physical reorganization presented in the Resolution under analysis.
