The aim of this Professional Sufficiency Paper (PSP) is the analysis of the powers and municipal autonomy concerning the Cassation 6332-2016, issued by the Supreme Court on March 28, 2018, related to the request for authorization to install telecommunications infrastructure, submitted by Nextel Peru (currently, Entel Peru) against the District Municipality of Castilla de Piura; thus, being a case in contentious-administrative matters. By means of the Cassation, the Court confirmed the inadmissibility of the request for failure to comply with the requirements of Ordinance 014-2011-CDC and the Regulations of Law 29022, approved by Supreme Decree 039-2007-MTC. The PSP has made it possible to identify whether the opinion adopted in the Cassation was issued in accordance with the legal system, considering the existence of a special regime of general scope applicable to the installation of infrastructure for the provision of public telecommunications services, as well as the municipal authority limits in this matter. For this investigation, various bibliographic sources have been used, including the provisions of the Political Constitution of Peru, laws, and regulations, as well as relevant doctrine and jurisprudence. After the analysis of the contradictory rulings that gave rise to the Cassation, it is concluded that any entity of the Public Administration -including municipalities- involved in the authorization for the installation of telecommunications infrastructure, must act and adhere exclusively to Law 29022 and its Regulations, taking into account the public goal of closing the telecommunications infrastructure gap.
