Abstract: El presente Trabajo de Suficiencia Profesional tiene como finalidad ofrecer un análisis del Recurso de Casación Nº 5761-2018-UCAYALI por la demanda interpuesta por Naviera J&A SAC contra Energy Services del Perú SAC en materia de obligación de dar suma de dinero. Es un proceso de casación mediante el cual, la Corte Suprema de Justicia determina que el comportamiento silencioso y evasivo de la parte demandada aunado a los medios probatorios presentados, han generado convicción de que entre las partes existió un acuerdo verbal de servicios fluviales, lo cual, nos abre las siguientes interrogantes: (i) ¿Los contratos escritos generan mayor seguridad jurídica sobre los contratos verbales? (ii) ¿Cómo se debe acreditar la celebración de un contrato verbal?
Luego la Corte Suprema señala que los comprobantes de pago presentados como medios probatorios, no han sido materia de cuestionamiento por la parte demandada, existiendo una presunción legal relativa de los hechos expuestos en la demanda, bajo lo cual surgen nuevas interrogantes: (iii) ¿Es suficiente la emisión de comprobantes de pago para acreditar una obligación de pago? (iv) ¿La Corte Suprema debería establecer ciertos requisitos mínimos para considerar a los comprobantes de pago como documentos suficientes para acreditar una obligación de pago?
Por lo señalado, durante el desarrollo del presente trabajo, será necesario determinar la problemática en relación a la celebración de los contratos verbales y su dificultad probatoria. Asimismo, determinar la importancia de los comprobantes de pago y las características que estos deberían tener para que su calidad probatoria sea suficiente.
The main objective of this document is to analyze Cassation No. 5761-2018-UCAYALI for the lawsuit filed by Naviera J&A SAC against Energy Services del Perú SAC regarding the obligation to give a sum of money. This is a Cassation process through which the Supreme Court of Justice determines that the silent and evasive behavior of the accused, added to the evidence presented, have generated the conviction that there was a verbal agreement for the execution of river services between both parties, which opens up the following questions: (i) Do written contracts generate greater legal certainty over verbal contracts? (ii) How should the conclusion of a verbal contract be proven? The Supreme Court points out that the payment receipts presented as evidence have not been a matter of question by the defendant, there being a relative legal presumption of the facts set forth in the lawsuit under which new questions arise: (iii) Is the issuance of payment vouchers sufficient to prove a payment obligation? (iv) Does the Supreme Court should establish certain minimum requirements to consider issuance payment vouchers as enough to prove a payment obligation? That is why, throughout the report it will be necessary to determine the problem in relation to the execution of verbal contracts and their evidentiary difficulty. Likewise, determine the importance of the payment vouchers and the characteristics that they must have so that their evidentiary quality is sufficient.
