The case in question focuses on Cassation Ruling No. 2284-2021-Junín presented in the context of the Peruvian judicial system. The central theme revolves around the impact of the so-called principle, known as due motivation, and also on the jurisprudential deviation (doctrine) in determining the sentence in a case of sexual assault against a minor. The primary source consulted is the cassation ruling issued by the Permanent Criminal Chamber of the Supreme Court of Justice of the Republic of Peru. The Public Ministry alleges against the reduction of the sentence imposed in the first instance in the hearing sentence, without adequate legal justification and in contravention of the doctrine of jurisprudence, formed in a Plenary Agreement. After a careful analysis of the case, the Supreme Court declares the appeal for cassation founded due to the impact of assumptions Nos. 1 and 5 of art. 429 of the CPP. As a result, the hearing sentence was revoked, thus maintaining the original sentence of thirty years in prison for the accused.
