The purpose of this research work is to develop the legal matter set forth in Plenary Ruling 50/2023 on the transcendence that every child has the right to identity, which entails having a name that is composed of the surnames of their parents, finding in debate the order of the surnames of the minor with initials M.S.C.C., in order to safeguard the principle of the best interest of the child. Consequently, the research topic of this paper is the relevance of the right to equality and non-discrimination between men and women on the basis of sex in today's society and how this influences the right to the identity of children. Certainly, in our country it has always been strictly assumed that the father's surname should be placed first and the mother's surname second. For this purpose, sources such as the order of priority of surnames as a fundamental right of identity of the child authored by Armas Muñoz et al. will be taken into consideration. (2022); the right to identity, affiliation and surnames of authorship of Álvarez & Rueda (2022); the construction of children's rights by Tobón Berrio & Isaza Gutiérrez (2021), among others. Finally, it will be concluded that there are legal provisions such as Article 20 of the Civil Code that require special attention in order to determine the order of surnames without affecting any fundamental right.
