In this work, the claim of the ODEBRECHT Economic Group for non-application of the impediments contemplated in literals m) and n) of section 11.1 is identified as the legal matter of Cassation Judgment No. 1957-2021/NACIONAL. of article 11 of Law No. 30225 to public contracts carried out with the National Authority for Reconstruction with Changes, due to the celebration of an effective Collaboration Agreement signed between the aforementioned Economic Group and the Public Ministry. In turn, the assumptions of impediments to state contracting have been selected as a research topic, belonging to Public Law. For this work, the analysis of documentary sources has been considered as consulted sources, such as the applicable regulations (Political Constitution, Laws Nos. 30225, 30556 and 30737, among others), as well as doctrine of Constitutional, Administrative Law, Penal and Premial contained in books and legal research articles. In conclusion, the Cassation Ruling No. 1957-2021/NACIONAL and the aforementioned research topic have been selected, considering that it involves current issues, such as international corruption, the legal interpretation of Public Law institutions and the affecting the freedom to contract with the State.
