In the instant case, a writ of habeas corpus was filed, which was finally considered by the Constitutional Court as an amparo proceeding. This ruling claims the violation of the right to food following the closure of nutritional support center, as it prevented the privileged from having access to subsistence food. This claim was upheld by the Constitutional Court, which ordered that the competent authority reinstate the center whitin thrirty days, under responsibility. From what was resolved by the highest interpreter of the Constitution, it can be observed that the problem that arose as a result of judgment, lies in being able to establish or determine whether the state has the duty to provide food to citizens who are in a state of vulnerability. In this regard, it is important to review and analyse international instruments to which the state is part, as well as various doctrines that link the right to food whit the life and dignity of the person, among others, which point out the role of the state and its duty towards people in a state of vulnerability whit respect to the right to food. Having analysed the instruments mentioned above, it can be concluded that the state, in seeking to protect the human person and respect for his or her dignity, it must ensure that its citizens are provided with the minimum standards of quality of life. Consequently, must provide people in vulnerable situations with access to the universal right to food.
