This legal analysis is based on demonstrating how good labor faith is violated in a fraudulent dismissal process. Good labor faith is a fundamental principle in labor relations, which implies that both the employee and the employer act in an honest, transparent and fair manner at all stages of employment, including the dismissal process. However, in some circumstances, this principle can be violated. These fraudulent actions can take various forms, such as denying the employee's legal rights and guarantees, making false accusations or inventing reasons to justify dismissal, among others. These types of harmful practices not only affect the employee directly involved, but also erode trust and balance in the workplace. They can also generate significant economic and emotional consequences for the affected employee, who may face difficulties in finding another job or suffer damage to his or her professional reputation. In this introduction, we will explain how labor good faith is violated within a fraudulent dismissal process, analyzing some of the common actions that can be considered as abuses in the labor environment, we will also highlight the importance of promoting a solid legal and ethical framework that protects the rights that affect trust in labor relations, emphasizing the need to take measures to prevent and punish these fraudulent practices that violate the fundamental principles of labor good faith, highlighting the importance of promoting a fair and respectful work environment for the welfare of all.
