This Professional Sufficiency Paper aims to analyze the Constitutional Tribunal's decision 197/2023, which orders the Ministry of Health to carry out as part of its public policy the free nationwide distribution of the Oral Emergency Contraceptive (OEC). The Court's decision specifically affects the exercise of the fundamental rights of girls and women in Peru, among which are sexual and reproductive rights, equality and non-discrimination, and the right to information. For the development of this work, we have consulted multiple sources, among them, Vlex; ProQuest; Ebsco-Ehost; and Scielo, since they are related to our subject, such as that of the author Suárez Gómez, in which she refers to the consequences of the Artavia Murillo decision in Peru and the conceived child. The analysis has been carried out in constitutional matters since the omission of such action by MINSA violates the previously mentioned rights. Therefore, we also evaluate the grounds used by the magistrates to cast their vote either in favor or against. In view of this perspective, multiple controversies arise in the way in which the State distributes the OEC pill, which is why we recommend that the MINSA carry out a control by way of supervision, to achieve an adequate use of the pill by women in the country, guaranteeing that their fundamental rights are fulfilled.
