The present investigation deals with one of the most iconic moments in Peru, this following the so-called “real estate boom” which meant a considerable increase in the sale of properties due to lower interest in the rates granted by the banks and this in turn It is thanks to the subsidies granted by the State through the MiVivienda fund, this at general levels, both positive and negative aspects, within the latter we can point out the frauds committed by organized criminal groups which offered and transferred other people's properties without the consent of the original owner. This is the reason why victims arise at different levels, finding in the first place the owner of the property, the Peruvian State and the third-party purchasers, this being the reason why through the ruling of the Constitutional Court that has file 0018 -2015-PI/TC that deals with the case of the third party in good faith, discussing the amendment of article 2014 of Law No. 30313; Therefore, the research topic will be the analysis of said modification seeking to demonstrate, with the help of books and scientific sources suitable for the case, the shortcomings and strengths. Finally, a solution proposal will be proposed, evidencing our position on the amendment in question, seeking to enforce the powers granted to public registries, of which registration advertising takes precedence, since we consider that the problem is not caused by a problem of the legal system that regulates the registration system as such, on the contrary, has an origin in society.
