The main objective of this investigation is to analyze the consequences of the Plenary Sentence 641/2021 of the Constitutional Court –file No. 02970-2019-PHC/TC–, being its main outcome to establish with precision the power of the father and mother to freely choose the order of the last name of their children. It is stated that a series of regulations persist in the Peruvian legal system that contribute to maintaining the inequality gap between men and women, such as the regulations that establish the order of last names (article 20 of the Civil Code). This legal situation, clearly, implies a disadvantage on women´s right to equality, which must be respected, protected, and guaranteed by the Peruvian State. To this end, the first chapter presents the main scope of Plenary Sentence 641/2021, considering the different votes of its judges. In chapter two, the decision of the Constitutional Court is contextualized in the current social reality, reviewing both official state sources and specialized research that present the limitations that Peruvian women currently face today for just being women. The legal reforms of other legal systems referring to the order of last names and their impact on the right to equality between men and women are also reviewed. Finally, chapter three presents the authors´ opinions on the importance of Plenary Sentence 641/2021 as a legal milestone and the need to continue reviewing national regulations to promote a more equal society between women and men.
