This paper focuses on a cassation case involving the recognition of a de facto union and the subsequent division of common property acquired during the cohabitation. The main dispute focuses on determining the starting date of the cohabitation and its conformity with the legal requirements to constitute a de facto union in the Peruvian legal context. The research topic concentrates on the precise determination of the date of commencement of cohabitation and the elements that constitute a de facto union under Peruvian law. This analysis is based on a wide range of sources, including academic articles by renowned authors such as Zuta, Hermoza, Aguilar and Anaya. In addition, legal regulations such as the country's Political Constitution and Civil Code are incorporated, along with articles from legal journals and newspapers that provide detailed information on the processing of de facto unions. The choice of this case and its research topic is justified by the importance and topicality of legal issues related to de facto unions in Peru. This approach is supported by a wide variety of relevant sources, both in jurisprudence and legal doctrine, which allows us to approach the topic from various perspectives and provide a comprehensive analysis.
