The objective of this professional work is to thoroughly analyze Ruling No. 00003-2021 PO/TC issued by the Constitutional Court, focusing on the most salient legal aspects in the constitutional and tax sphere. The case revolves around the dispute presented by the Bar Association of Lima Sur and the Bar Association of Huaura against specific sections of Legislative Decrees 1313 and 1434, amendments that affected Article 143-A of the Financial System Law. The controversy lies in the constitutionality of regulations that allow the lifting of bank secrecy and tax reserve in exceptional situations, as a strategy against tax evasion and avoidance. This creates a dilemma between the duty to contribute and citizens' right to bank secrecy. The bar associations argued that these regulations violate constitutional guarantees, aiming to protect the fundamental right to bank secrecy and financial privacy. Despite this, the Constitutional Court, in its ruling, largely dismissed the claim, except for the dissenting vote of Justice Ferrero on Article 3 of Legislative Decree 1434. The work will analyze this issue, based on the ideas of experts like Soto and Zuluaga, who defend the preservation of the right to bank secrecy without compromising the general interest. Furthermore, the opinion of Corti and Bolaños & Ordoñez, who argue that the duty to contribute should be aligned with each individual's financial capacity, will be considered. Lastly, the importance of safeguarding the essential right to bank secrecy will be addressed.
