The present work of professional sufficiency has as its objective the analysis of Cassation No. 18404-2017-CUSCO, which deals with the appeal filed by the Provincial Municipality of Cusco against the judgment of hearing, for the cause established in Article 386 of the Code of Civil Procedure, referred to the normative infringement of paragraphs 3 and 5 of Article 139° of the Political Constitution of Peru and Articles 1 and 2 of Law No. 24041. The plaintiff in this proceeding is Korina Maximiliana Santivañez Venero and the defendant is the aforementioned entity. In the development of the litigation, important issues of labor law are debated, among which are: the administrative contracting of services (CAS), the principle of the primacy of reality and due motivation. Thus, the work will start with a summary of the case in order to carry out an exhaustive analysis of the treatment given by the Peruvian legal system and the Supreme Court to the elements described. Likewise, we will make a critique of the CAS and its injury to the labor rights of the workers assigned to this regime. For this purpose, the main sources we will use are the Political Constitution of Peru, the Civil Code, Law No. 24041, Legislative Decree No. 276, compilation of jurisprudence and doctrine dealing with the subject matter to be analyzed, among others.
