The present Work of Professional Sufficiency has led us to investigate whether the lack of regulation of same-sex marriage in the Peruvian legal system transgresses the constitutional rights to equality, non-discrimination and free development and welfare of the human being, based on Judgment Nº172-2022 issued by the Constitutional Court, which declared inadmissible the amparo suit filed by the plaintiffs with initials A. A.M.S and D.A.U.F, through which they requested the recognition before the National Registry of Identification and Civil Status (hereinafter called, RENIEC) of their marriage celebrated in the city of New York, United States. In this sense, this research has been based on the analysis of different norms belonging to the Peruvian legal system, doctrinal contributions and international jurisprudence. The development of the research carried out allows us to conclude that it is necessary to protect the fundamental rights of persons of the same sex who seek to live together. To this end, it is essential that the Congress of the Republic approves the creation of a new legal figure that allows for: i) the decision to live together between homosexual couples to be expressly recognized and regulated in the Peruvian legal system, ii) allows homosexual couples to obtain rights and obligations, and iii) grants them full enjoyment of their fundamental rights to equality, non-discrimination and free development and wellbeing.
