This paper is about the analysis carried out in the dispute that arose between the company Aerovías del Continente Americano S.A. (hereinafter, Avianca) and the National Institute for the Defense of Competition and the Protection of Intellectual Property (hereinafter, Indecopi) in the proceeding under Administrative Litigation Dossier No. 02922-2018-0-1801-JR-CA-25, where the nullity of a resolution or administrative act is being discussed. The main analysis will focus on two fundamental issues: i) determining what is meant by the “duty of information“ that all providers are obligated to fulfill, and ii) the correct interpretation of Article 66.7 of Law No. 29571 - Consumer Protection Code (hereinafter, the Code) regarding the endorsement of domestic air tickets. To do this, we will turn to sources such as Morón and Barra, who provide key definitions related to the “administrative act,“ while Gutiérrez, Northcote, Torrejón, and Carbonell offer interpretations and explanations regarding consumer protection, the adequacy as an obligation of providers, and the duty of information. These are just some of the sources that will be used for this work. Our choice is based on the interest in contributing to the understanding of these issues, their impact on consumers, and their application in real-life situations. Furthermore, addressing these issues provides valuable insights in the field of law and consumer rights defense, especially in a national market that currently offers a wide range of air and land transportation services, where the information asymmetry between the provider and the consumer can become increasingly complex.
