The objective of this work is to analyze Judgment No. 641/2021 in relation to File No. 02970-2019-PHC/TC, on the scope of the order of surnames in our legal system and the violation of fundamental rights that has been committed. been doing in previous years by not giving parents the option to decide on it. Regarding the above, this analysis is carried out taking into consideration that there is currently jurisprudence issued by the Constitutional Court in which the choice of the priority of children's surnames falls on the decision of the parents. Therefore, the research work seeks to specify the concepts of equality and non-discrimination based on sex, identity and priority of surnames, through various bibliographic sources such as articles from indexed magazines, books by national and international authors and jurisprudence of the Constitutional Court, which will provide greater depth to our critical analysis of the reasons that led to the decision of the Constitutional Court and the unique votes that accompany it. Finally, the work proposes a method of solution to the disagreement of parents regarding the order of their children's surnames, through Ad-Hoc Arbitration in family matters. This seeks to avoid going to a jurisdictional body since this could generate a delay, which would directly and substantially affect the right to identity of the minor who needs to register his or her full name on his or her birth certificate.
