In the professional sufficiency work, the application of the precautionary principle will be analyzed for cases in which the rights to install telecommunications antennas converge (as part of the right to free private initiative) and; on the other hand, the right of people to enjoy a balanced environment. In this context, the first instance declared the claim unfounded considering that the damage was not proven; while the second instance decided to declare it inadmissible, since it considered that this controversy, since it contained arguments of invalidity of the defendant's contracts, would require evidentiary action and the protection process would not be the ideal way. Then, the Constitutional Court decided by majority to declare the claim unfounded, applying the precautionary principle since it was considered that there are no indications that affect the environment. However, there is a singular vote that considers the opposite. Thus, the research topic is to establish the adequate application of the precautionary principle, for this purpose we resorted to doctrine, jurisprudence and the international, constitutional and legal framework (International Conventions). Finally, considering the information obtained, it is proposed as a solution that constitutional judges when resolving these conflicts apply the precautionary principle and, by virtue of this, carry out ex officio tests to determine the existence of signs of damage to the environment, as well as order subsequent evaluations. to the sentence, to verify if it is still maintained without exceeding the permissible limits that damage the balanced environment.
