The revocation of administrative acts is a highly debated topic nowadays. This is largely because it grants the Public Administration the authority to extinguish the rights of the administered, and its misuse could lead to the so-called indirect or illegal revocation, thereby violating the due process established in articles 203 and 205 of Law 27444 - General Administrative Procedure Law. In this context, we will carry out a critical analysis of Cassation 774-2020, where we question the possible existence of an indirect revocation by the Municipality of Miraflores. This analysis will focus on the partial modification of an operating license granted to the company JCH EIRL, which was purportedly "regulated" by ordinance 263-2007. In light of this, solutions will be proposed to restrict the indiscriminate and arbitrary use of 'revocation' by provincial or district municipalities, thus safeguarding the right to due process, defense, and legal certainty held by administered individuals within the constitutional and administrative framework.
