The present Professional Sufficiency Work is about the binding precedent established by the Constitutional Court in file No. 00142-2011-PA/TC, which establishes, among others, the power of arbitrators to apply Judicial Review and its scope for its correct application in the arbitral process. In addition, the concepts of jurisdictional function and Judicial Review will be analyzed theoretically, with doctrinal support, as well as their applications in the arbitral forum. In the first of these concepts, the opinions in favor and against that exist in the matter will be highlighted, as well as what was resolved by the Constitutional Court in order to elucidate said dilemma. In the second concept, its application will be analyzed from the perspective of recent cases, which are two Emergency Arbitration Proceedings.
