The plaintiff requests that the contract for the sale of a property made by the representative of the College of Psychologists (seller) be declared null and void in favor of C.I.N.C. (buyer) for the reasons of illicit purpose and contravention of the rules of public order and good customs; However, the Judiciary declared the claim inadmissible, considering that the request for annulment is not related to the facts on which it is based, since these would refer to a case of ineffectiveness. In this sense, the subject of investigation is whether it is appropriate to sanction with ineffectiveness or nullity the sale of a property by a person without having representation to exercise the power to dispose of assets. To do this, the doctrine, jurisprudence of the Supreme Court, the full Civil Cassation proceedings related directly and indirectly to the case and the substantive norm will be analyzed. In conclusion, this work of professional sufficiency aims to propose as a solution that when a person enters into a sale by virtue of a representation that does not grant powers to dispose, the legal consequence is that we are faced with the ineffectiveness provided for in art. 161 of the Civil Code, but not in cases of causes of structural ineffectiveness (nullity or voidability). It would not constitute nullity due to lack of expression of will, since the representative expressed his willingness to sell on behalf of the College of Psychologists, so what did not exist is that he had those powers.
