The purpose of this essay is to analyze the connection between the constitutional right to due process and the right to proper justification of resolutions in administrative proceedings. To achieve this, the Constitutional Court's judgment in case No. 03891-2011-PA/TC will be used as the basis for analysis. In this case, the question arises as to whether the exercise of discretionary power by the administrative authority is a sufficient reason to establish proper justification as a fundamental requirement of an administrative act. Furthermore, an examination will be conducted to determine whether the Constitutional Court should have addressed the substance of the matter or limited itself to acting as an appellate court. To do so, the opinions expressed in the majority vote of the aforementioned judgment will be considered, along with the dissenting singular vote. Additionally, the legal analysis of this work will be strictly confined to the jurisprudence and regulations necessary to reach a fair and compatible conclusion within the normative framework.
