In the present work we analyze an issue of labor law that, in our opinion, has not been correctly evaluated in Sentence 286/2023, because the analysis of the denaturalization of the contract is omitted, denying permanent replacement to the public worker who has suffered a void dismissal, due to the Huatuco precedent. Therefore, this research deals with the permanent replacement of public sector workers, whose civil contracts have been denatured and have suffered a null dismissal, its analysis being relevant because currently in public institutions there is a large number of denatured service rental contracts, since they perform personal, subordinate and paid work, characteristics of an employment contract, making it necessary to apply the principle of primacy of reality. For this reason, when the contractor does not renew the contract for reasons that affect his rights, the workers proceed to sue the contractor for null dismissal, seeking reinstatement. For the investigation of this work, various sources of information collection were used, such as books, magazine articles, jurisprudence and laws, which allowed the correct analysis and obtaining of the conclusion regarding the aforementioned topic. Finally, we can affirm that, in merit of fundamental labor rights and the application of the principle of the primacy of reality, it is reasonable to provide for the permanent reinstatement of public sector workers who have had a denatured civil contract. and have suffered a null dismissal.
