In 2001, Law No. 27495 incorporated de facto separation as a ground for divorce and the corresponding compensation into the Civil Code. However, the latter's imprecise wording has led to various interpretations. Hence, the Third Plenary Ruling aims to rectify this by providing guidelines for rendering judgments regarding Article 345-A compensation. Cassation No. 1784-2018-San Martin involves two legal claims: divorce due to de facto separation and divorce based on adultery. The core of the dispute revolves around the simultaneous application of compensation for these two grounds. This work analyzes the application of compensation governed by Article 345-A, addressing both property distribution and personal damage compensation. It also explores the application of Article 351, dealing with potential moral damage caused by adultery. These considerations raise a fundamental question: Is it possible to apply dual compensation in cases of de facto separation and adultery? For the analysis, we will draw on well-founded principles from the legislation and doctrine of Argentina, Chile, and Peru to define relevant case concepts. Additionally, we will rely on the Third Plenary Ruling on Civil Matters. In conclusion, while moral damage is subsumed within the general concept of personal damage, a more meticulous development is needed due to the lack of motivation in the judgment.
