This work of professional sufficiency deals with the violation of the principle of ex officio impulse and due process in the administrative sanctioning procedure against the company J&M Ejecutores SAC. Grounds alleged in the cassation appeal filed against the judgment contained in resolution number five, dated April 4, two thousand eighteen, issued by the Fourth Chamber Specialized in Administrative Litigation of the Superior Court of Justice of Lima. The research topic to be developed, focuses mainly on the violation of the principle of the burden of proof by the OSCE and the improper application of the principle of presumption of truthfulness. This violation is evidenced by the lack of evaluation of the only evidence that would help to determine the plaintiff's liability, as an alleged member of the JJF Consortium, for the unjustified non-subscription of the contract with the Regional Government of Lambayeque. This principle is essential and important for the proper development of any administrative proceeding. They are indicated and pointed out in Law 27444, General Administrative Procedure Law. As well as, developed by authors such as Guzmán Napurí, Morón Urbina, Huapaya and others. Based on this, we will proceed to analyze the grounds considered in the judgment of Cassation No. 16322-2018-Lima, in order to highlight the lack and incorrect application of the principles mentioned by the OSCE during the development of an administrative sanctioning procedure.
