For a long time, there has been a significant debate regarding the legal act of disposing of marital property by one of the spouses. Therefore, with the publication of the VIII Plenary Case Law on Civil Matters, it was established that the solution would depend on how the case is presented. In some situations, the correct legal action against the act of disposal will be a nullity claim, in others, it will be a claim of ineffectiveness. Furthermore, it also pointed out as another precedent the possibility for the affected spouse to file a reclamation action. Regarding this last precedent that allows the reclamation action, in practice, there are aspects that need to be taken into account for its submission through a lawsuit or cumulative claim. Mere invocation of this remedy is insufficient; it is necessary to consider and analyze various factors that could hinder this action and situations in which reclamation is the only way for the affected spouse to recover the property disposed of by the other. Based on the consulted sources, such as doctrine and jurisprudence, it is concluded that the first step the aggrieved spouse should consider for the reclamation action is to determine who has possession of the property. It is also concluded that the maximum utility of reclamation will be realized when, after the extinguishment of either nullity or ineffectiveness due to prescription, the only remedy and/or way to recover the property is reclamation, with its only limitation being adverse possession.
