The objective of this Professional Sufficiency Work was to address the criteria used by the Constitutional Court in Plenary Sentence No. 671/2020, through which the constitutionality of Legislative Decrees No. 1400 and No. 1409 was determined; with the contrast of the singular vote cast by Judge Ernesto Blume Fortini, who voted in favor of the unconstitutionality of said decrees. Therefore, the object of the study was the analysis of submission with the requirements established in Authoritative Law No. 30823 by the Executive Branch, that is, was analyzed whether the sixty (60) day period for issuance was met. of the regulations, and whether the scope of the authoritative law was respected in relation to the subject of economic management, competitiveness and modernization of state management, without restricting notarial or registry powers. In this regard, the basis of the study is based on extensive doctrinal, jurisprudential and legal knowledge, as well as the exposition of technical reasons and legal reports of the questioned legislative decrees. Finally, taking into account the investigation carried out, was considered that the decision of the Constitutional Court, by which the claim is declared unfounded and the constitutionality of the legislative decrees is ratified, finds its basis in the Political Constitution of Peru and in the arguments presented by the Executive Branch, which efficiently justify the issuance of said regulations, so our position is in favor of the ruling issued by the collegiate body.
