This professional sufficiency work consists of evaluating the proportionality test: the right to life vs. the right to die with dignity in the consulted judgment issued by the Supreme Judge of First Instance. Applying diffuse control, Article 112 of the Penal Code is not applied to the case of Ana Milagros Estrada Ugarte, who suffers from a condition called Polymyositis. In this regard, the first chapter covers the background, relevant foundations, and analysis of the votes of the Supreme Judges in the case under study. On the other hand, the second chapter presents relevant legal concepts for this case, such as the right to life, human dignity, euthanasia, palliative care, mercy killing, the right to die, diffuse control, and the proportionality test. In the third chapter, the assessment of the proportionality test and its subprinciples applied by the Supreme Judges regarding the citizen's request for a dignified death through euthanasia is analyzed. In this regard, with the doctrine, jurisprudence, and analyzed regulations, it is concluded that the application of the proportionality test in relation to the right to die with dignity is not met, as the latter is not regulated in Peruvian legislation. In this context, palliative care is considered a less burdensome alternative and is regulated in our country. However, there is a need to promote and strengthen the Palliative Care System in light of the current healthcare crisis.
