The case in question involves an eviction claim due to precarious occupation, in which the claim was declared founded in the first instance. For its part, in the second instance the appealed sentence was revoked and reformed, the claim was declared inadmissible because the plaintiff lacked legitimacy to act. Likewise, the Civil Chamber of the Supreme Court of Justice declared the appeal unfounded, considering that the plaintiff lacks legitimacy to act. Although the Civil Chamber of the Superior Court and the Civil Chamber of the Supreme Court agree that the plaintiff lacks legitimacy to act; However, the arguments are different. Furthermore, we consider that the reason for the inadmissibility of the claim is not fully justified, since the concepts of legitimation and ownership are confused in the analysis. Therefore, it was appropriate to issue a ruling on the merits of the disputed matter in the sense of whether or not the defendant has the title to possess, that is, whether or not he is a precarious occupant according to the facts and the evidence presented. In this sense, in this work we will analyze whether the decision adopted by the Civil Chamber of the Supreme Court is reasonable due to the arguments presented. To do so, a dogmatic descriptive method will be developed, taking into account doctrinal and jurisprudential sources.
