The present research is aimed at studying the fundamental rights of children as developed in Judgment No. 1590-2019-Cusco, issued by the Permanent Civil Chamber of the Supreme Court of Justice of the Republic on September 3, 2020, which pertains to the matter of challenging extramarital paternity. Within the fundamental rights under investigation, we encompass the right to identity, a right protected at the constitutional level, both in its static and dynamic aspects, in order to safeguard the principle of the best interests of the child, which must be taken into account before issuing a pronouncement regarding each specific case of extramarital paternity challenge. For the development of our professional sufficiency work, we have turned to the Political Constitution of Peru as the protector of the institution of the family, the Children and Adolescents Code (Law 27337) that safeguards their right to identity, and the Convention on the Rights of Children and Adolescents that upholds the principle of the best interests of the child, among other national and international sources. In light of the above, it is concluded that, along with the principle of the best interests of the child, the right to identity in its dynamic and static dimensions must be considered by the Judge when resolving a case of extramarital paternity challenge in order to ensure their physical and mental well-being, as well as their full development.
