Intellectual property or intellectual property rights refers to the creation and protection of an invention, which has been highly demanded in recent years due to the consumption and sale increase of medicines in public and private healthcare after various diseases treatment. Trade relations involving treaties and agreements have provided Peru access to many products requested on an emergency basis, such as medicines. As a result, Peru has been able to increase its imports of brand-name or generic drugs, including its property rights. Regarding the importance of this product during these times, this study aims to analyze the regulation of Peruvian intellectual property and its impact on the process of importing drugs of U.S. origin between 2017 and 2022, considering patents, TRIPS agreement, and Peru-US FTA. The study uses a qualitative approach, a design based on its theory and descriptive scope, and all the data was collected through ten interviews with representatives of drug importers, private and public institutions, and experts in the topic studied. The results show that intellectual property or intellectual property rights emphasize the use of protection for health products, allowing for increased trade, as reflected in imported medicines.
