Abstract: La Sentencia del Tribunal Constitucional materia de análisis (STC N° 01064-2013-PA/TC) tiene especial trascendencia para el análisis jurídico, toda vez que aborda la problemática de la cosa juzgada de los laudos arbitrales.
La controversia bajo revisión se suscita debido a la admisión a trámite de 2 demandas de anulación de laudos arbitrales, pese a que estos ya habían quedado firmes y por lo tanto adquirido los efectos de la cosa juzgada arbitral.
En ese sentido, será materia de revisión en el Informe Jurídico si es que se está afectando o no los denominados efectos de la cosa juzgada en el caso de los laudos arbitrales que son objeto de controversia.
The Constitutional Court Judgment subject of analysis (STC No. 01064-2013-PA/TC) has special significance for legal analysis, since it addresses the issue of res judicata of arbitral awards. The controversy under review arises due to the admission for processing of 2 claims for annulment of arbitral awards, despite the fact that these had already become final and therefore acquired the effects of arbitral res judicata. In that, it will be a matter of review in the Legal Report whether or not the so-called effects of res judicata are being displaced in the case of arbitration awards that are the subject of controversy.
