Abstract: El presente informe es elaborado en referencia al Expediente N.º 06855-2013-PHC/TC emitido por el Tribunal Constitucional, en el que se pone en consideración y delimitación el derecho al libre tránsito en los predios colindantes sin acceso. Además, dicho instrumento busca precisar conceptos como la inviolabilidad del domicilio, diferencias entre la servidumbre de domicilios habituales y domicilios de segunda vivienda. Por último, se describe, brevemente, si el proceso de hábeas corpus es el mecanismo adecuado para poder proteger tal derecho, al conceptualizar el derecho a la libertad individual.
This report is prepared in reference to case file number 06855-2013-PHC/TC issued by the Constitutional Court. The aforementioned case puts into consideration and delimitation the right to free passage on adjacent lands without access. Furthermore, this document seeks to clarify concepts such as the inviolability of the home, differences between servitudes of primary residences and second homes. Finally, it briefly describes if the writ of habeas corpus process is the appropriate mechanism to protect said right to freedom when conceptualizing the right to individual liberty.
