Through this current work of professional sufficiency, an analysis of the legal figures that exist in our legal system will be carried out and the legal controversies of the eviction process initiated by Mr. Jhon Rusel Hurtado Valencia against Mr. Bacilio Teodosio Ascencio Rivera and others will be resolved. Furthermore, in the disciplinary administrative procedure in the matter of consumer protection initiated by Mr. Wilder Jorge Puchoc Varela against Scotiabank Perú S.A.A. and others for alleged violations of the duty of suitability and inadequate attention to claims referred in the Consumer Protection and Defense Code (hereinafter, the Code). The civil file refers to the legal controversy throughout which the alleged precarious possession of the property subject to litigation was analyzed, requesting the eviction of the defendants. In this regard, the judges formulated contradictory judgments since the first instance declared the claim inadmissible and the second instance declared the claim founded, in addition to this an appeal was present this was declared unfounded by the Supreme Court. The administrative file deals with the alleged violations of the duty of suitability of the service referred to in articles 1 literal c), 18, and 19° and the lack of adequate attention to the claims made according to article 88.1 of the Code, sanctioning Scotiabank Perú S.A.A in the first instance for the exposed infractions, being revoked in the second instance declaring unfounded due to infringement of the duty of suitability and confirming the decision of the first instance related to the lack of adequate attention to the claims.
