Abstract: El presente trabajo desarrolla la sentencia del Tribunal Constitucional de fecha 25 de julio de 2019, recaída en el Expediente N.º 0005-2016-PCC/TC que trata sobre la demanda de conflicto de competencias interpuesta por el Poder Ejecutivo contra el Poder Judicial, por considerar que este último ha menoscabado las atribuciones del Poder Ejecutivo a través de la expedición de resoluciones judiciales que otorgan derechos y permisos de pesca a los administrados, desconociendo así la competencia exclusiva del Ministerio de la Producción y de lo regulado por la normativa correspondiente.
En el desarrollo del presente trabajo, se analiza el petitorio de la demanda, la legitimación de las partes, los fundamentos de la demanda sobre la vulneración de atribuciones, los argumentos de la contestación de demanda y las intervenciones de los terceros. Asimismo, se desarrollará la decisión adoptada por el Tribunal Constitucional que consta en la sentencia, así como los vicios competenciales que se han encontrado. Por último, se abordará los votos de los magistrados, así como mi opinión sobre la presente demanda competencial.
This document develops the Constitutional Court's Judgment dated on July 25, 2019, handed down in Case N° 0005-2016-PCC/TC which deals with the lawsuit of conflict of competence filed by the Executive Branch against the Judicial Branch, for considering that the Judicial Branch has infringed the attributions of the Executive Branch through the issuance of judicial resolutions that grant fishing rights and permits, ignoring the exclusive competence of the Ministry of Production and what is regulated by the pertinent regulations. In the development of this document, will be analyzed the request of the lawsuit, the legitimacy of the parties, the arguments of the claimant, the arguments of the defense and the interventions of the third parties. Likewise, the decision adopted by the Constitutional Court as set forth in the judgment will be developed, as well as the competence flaws that have been found. Finally, the votes of the judges will be discussed, as well as my opinion on the present conflict of competence.
