Abstract: El expediente versa sobre una demanda civil de divorcio por la causal de separación de hecho interpuesta por el Sr. J.E.W.C contra la Sra. C.I.C.C. El proceso, contiene dos puntos fundamentales a analizar: (a) verificar el cumplimiento o no de los elementos de un divorcio por la causal de separación de hecho y (b) el estudio de los presupuestos necesarios para atribuirle a una de las partes la calidad de “cónyuge perjudicado” según lo establecido en el artículo 345-A del Código Civil y en el Tercer Pleno Casatorio Civil.
Asimismo, a lo largo del proceso, se debate también el otorgamiento de una pensión de alimentos a favor de la demandada (Sra. C.I.C.C), la nulidad de un acto procesal y presuntas afectaciones al derecho del debido proceso y el derecho a la motivación de resoluciones judiciales.
En esta línea, el caso planteado, encuentra su principal relevancia al estudiar los elementos configurativos de un divorcio por separación de hecho y el análisis de la figura de “cónyuge perjudicado”.
The case is about a lawsuit of divorce on the grounds of a factual separation filed by Mr. J.E.W.C against Mrs. C.I.C.C The process focuses its discussion, mainly, on two fundamental points: (a) determining whether or not the requirements for the configuration of the divorce on the grounds of a factual separation are met and (b) analyzing whether or not the elements to establish one of the parties as “harmed spouse“ are met in light of the Article 345-A of the Peruvian Civil Code and the provisions of the Ruling issued in the Third Plenary Civil Cassation held by the Permanent and Transitory Civil Chambers of the Peruvian Supreme Court of Justice. Likewise, throughout the process, the granting of an alimony in favor of Mrs. C.I.C.C, the nullity of a procedural act and alleged violations of the right to due process and the right to the motivation of judicial decisions are also debated. In this line, the case presented finds its main legal and academic relevance when studying the fulfillment of the elements of a divorce on the grounds of a factual separation and the discussion regarding the granting of the quality of “harmed spouse“ in Family Law.
