Objective: To determine if there is an association between the type of contract and the presence of depressive symptoms in the public sector physicians, Peru 2016. Methods: A cross-sectional study was carried out secondary to the analysis of the “Encuesta Nacional de Satisfacción de Usuarios en Salud 2016” (ENSUSALUD). The population includes doctors from various health facilities of the Ministry of Health (MINSA-Gobiernos Regionales) and Social Security (EsSalud) of Peru. The main variable was measured using the Patient Health Questionnaire-2 scale (PHQ-2). The exposure variable, type of contract, includes the following: Locación de Servicios, Contrato Administrativo de Servicios (CAS), Contrato a Plazo Fijo (sujeto a modalidad), Nombrado (D.L. 276) or Plazo Indeterminado (D.S. 728). In the analysis, the calculation of raw and adjusted Prevalence Ratio (PR) with a Confidence Interval of 95% (95% CI) was performed. Results: 2041 physicians were included in the study (MINSA-Gobiernos Regionales: 1012, EsSalud: 1029). 26,3% of MINSA-Gobiernos Regionales were women; and, in EsSalud, 30,6%. The average age was 45 years and the standard deviation was 11,8. The prevalence of depressive symptoms in MINSA-Gobiernos Regionales was 18,7% and 15,8% in EsSalud. In MINSA-Gobiernos Regionales, the most frequent contract was that of Nombrado and in EsSalud, Plazo Indeterminado. In MINSA-Gobiernos Regionales, no statistically significant differences were found in the prevalence of depressive symptoms and type of contract. On the other hand, in EsSalud, we found that, in comparison of the group hired under the modality of Nombrado, those of Plazo Indeterminado had 4 times higher prevalence of depressive symptoms (IC95%: 3,2 to 159,7); Contrato a Plazo Fijo: 6 times (IC95%: 1,5 to 25,0); CAS: 10,4 times (IC95%: 1,9 to 56,8) and Locación de Servicios: 22,5 times higher (IC95%: 3,2 to 159,7). Conclusions: In MINSA-Gobiernos Regionales there are no differences in prevalences; however, in EsSalud those hired under the modality of Plazo Indeterminado, CAS, Locación de Servicios and Contrato a Plazo Fijo, had greater prevalence of depressive symptoms than the staff hired under Nombrado.
