The purpose of this scientific study is to reduce the discretion of the administrative authority when imposing sanctions in cases of sexual harassment at work and nepotism, in observance of the constitutional principles of reasonableness and proportionality within the framework of the civil service law. For this reason, the orientation of the present research is qualitative, using the documentary collection technique and the in-depth interview with 04 experts. The results revealed that the sanctioning discretionality of the Entity's authorities, empowered to sanction, causes a violation of the principles of reasonableness and proportionality. This situation is revealed when the entity that imposed the sanction does not comply with the requirements or procedures established in Law No. 30057; or, when the entity does not correctly motivate the fault, guaranteeing the due administrative process. Finally, it is concluded that, in order to reduce the discretion in the imposition of sanctions by the administrative authority in two different cases, graduation criteria should be used. These criteria must take into account the seriousness of the alleged offense. It is essential that the assessment to determine these graduation criteria, based on the seriousness of the alleged infringement, is properly considered and detailed in the resolution imposing the sanction. This approach ensures that the reasons behind the sanction are clearly stated, thus allowing the assessment of whether the severity of the sanction is appropriate to the nature of the offense. As a result, it can be determined whether the sanction in question is fair and appropriate in relation to the principles of reasonableness and proportionality
