Abstract: El daño al proyecto de vida es un caso particular y paradigmático del impacto que
ejercen los ordenamientos latinoamericanos en el fortalecimiento de la protección de
las víctimas que han sido afectadas por la violación de sus derechos humanos. Este
impacto es un elemento de análisis para los sistemas jurídicos internos, por eso se
debe tener plena certeza y tomar conciencia del rol de los jueces y tribunales en el
tratamiento y desarrollo de la protección de los derechos fundamentales de la persona,
lo que se lograría por medio de sólidos valores y principios que deberían poseer los
órganos encargados de administrar justicia y, también a través de la elaboración de
construcciones jurídicas que implementarían ampliamente el Derecho en cada país.
Al respecto, una construcción dogmática y jurisprudencial como la figura del daño al
proyecto de vida revela una singular y especial sensibilidad de los juristas y
operadores del Derecho frente a las graves lesiones y alteraciones causadas por actos
o hechos ilícitos que transgreden y vulneran los derechos humanos y que perjudican
drásticamente el proyecto de vida de un sujeto.
Debido a la naturaleza del daño inmaterial que posee el daño al proyecto de vida, ésta
produce una variedad de dificultades para que los jueces y tribunales afronten la
valoración y cuantificación de la reparación en este tipo de daño. Sin embargo, esto
no sería justificación suficiente ni excusa aceptable para que dejen de cumplir con
determinar la correcta y justa reparación que le corresponde a la persona agraviada y
perjudicada por la vulneración de sus derechos fundamentales, en especial
consideración en torno al daño al proyecto de vida.
The damage to the life project is a particular and paradigmatic case of the impact that the Latin American legal systems have on the strengthening of the protection of victims who have been affected by the violation of their human rights. This impact is an element of analysis for the internal legal systems, that is why we must have full certainty and be aware of the role of judges and courts in the treatment and development of the protection of the fundamental rights of the person, which would be achieved through solid values and principles that should be held by the bodies in charge of administering justice, and also through the elaboration of legal constructions that would widely implement the law in each country. In this regard, a dogmatic and jurisprudential construction as the figure of the damage to the life project reveals a singular and special sensitivity of jurists and legal operators in the face of serious injuries and alterations caused by acts or unlawful acts that transgress and violate human rights and that drastically damage the life project of a subject. Due to the nature of the non - pecuniary damage that the damage to the life project has, this produces a variety of difficulties for the judges and courts to face the assessment and quantification of the reparation in this type of damage. However, this would not be sufficient justification or acceptable excuse for them to stop complying with determining the correct and just compensation that corresponds to the person wronged and harmed by the violation of their fundamental rights, especially regarding the damage to the life project.
