This thesis entitled: ““THE RELATIONSHIP BETWEEN THE PRINCIPLE OF THE JUDGE KNOWS THE LAW (IURA NOVIT CURIA), AND THE CONTRADICTORY, IN THE CURRENT PERUVIAN CIVIL PROCESS““, has as its main course, to carry out a dogmatic analysis of two important and somewhat opposite of our judicial process, especially the Peruvian civil process. It also seeks to offer more insight into what is to be understood by the old brocardo ““the judge knows the law““, for this reason, within our theoretical framework we have dedicated several lines to the study of said principle. Necessarily also, we have analyzed the fundamental principle of the contradictory, within our theoretical framework, for this reason we have compiled the opinion of various authors of both national and comparative doctrine. The separate analysis of both principles has inevitably led us to also dedicate several lines to the relationship between authority or judicial power and the limits that this could have. Hence, in our analysis and discussion of the results we have ended up pointing out the way in which these two opposing principles complement each other, thus reaching our stated general objective.
