The purpose of this thesis report was to determine how the current regulation of compensation for accidents at work established in Article 53 of the Law on Safety and Health at Work affects the burden of proof. In the information gathering stage for the elaboration of the thematic dispersion of the chapters of the theoretical framework, the sources of consultation were used, such as books, legal journals, national and comparative legislation and jurisprudence, using the information sheets as the information collection instrument. Registration and research. Regarding the results of the research developed in the chapters of the theoretical framework, it was obtained that in the doctrine the reversal of the burden of proof is an expression of the protective principle of labor law; In Colombian jurisprudence the burden of proof is reversed when it comes to work-related accidents and in Spanish legislation it is established that in the case of work-related accidents, the burden of proof corresponds to the employer. The main conclusion of the investigation work is that the current regulation of the compensation for accidents at work established in article 53 of the Law of Safety and Health at Work negatively affects the burden of proof, as it does not regulate in a taxative manner who is responsible for the burden of proof, which violates the protective principle of the worker and legal certainty, so it is recommended that article 53 of the Occupational Health and Safety Act be modified in the sense of presuming the burden of proof in favor of the worker, for being the weakest part of the labor relationship.
