Los estándares establecidos por la corte interamericana en los procesos de antejuicio político en el Perú

Abstract

La presente investigación encuentra su fundamento en la necesidad de mostrar si el Parlamento de la República respeta la garantía constitucional del debido proceso “en los procedimientos de antejuicio político” que se desarrollan en su seno. Con esa finalidad hacemos un estudio sobre el Parlamento y sus funciones, básicamente sobre la función de control político o función controladora del Parlamento, de donde se desprende esta facultad para someter a los funcionarios aforados a procedimiento de antejuicio y juicio político. Asimismo, examinamos la “sentencia de la Corte Interamericana de Derechos Humanos en el caso Tribunal Constitucional contra Perú”, en la cual esta Corte fija el estándar interamericano de debido proceso en “antejuicio y juicio político”. Finalmente, analizamos a la luz de esta sentencia el caso del ex “Contralor General de la República, Edgar Alarcón Tejada”, con la finalidad de determinar si el Congreso de la República respeta el estándar de debido proceso en sede parlamentaria fijado por la Corte IDH.

The present investigation finds its foundation in the need to show if the Congress of the Republic respects the guarantee of due process in the procedures of political pre-trial that take place in its midst. To that end, we conduct a study on the Parliament and its functions, basically on the function of political control or controlling function of the Parliament, from which this power is derived to subject the recalled officials to pre-trial and impeachment proceedings. Likewise, we examine the judgment of the Inter-American Court of Human Rights in the Constitutional Court case against Peru, in which this Court sets the inter-American standard of due process in pre-trial and impeachment. Finally, we analyze in the light of this judgment the case of the former Comptroller General of the Republic Edgar Alarcón Tejada, with the purpose of determining whether the Congress of the Republic respects the standard of due process in the parliamentary seat set by the Court
