This research work called ““Article 36, of Law N°. 29973, on accessibility to Educational Institutions and the right of people with disabilities in Trujillo, 2021““, is aimed at determining whether article 36, of Law N°. 29973, on the Accessibility to Educational Institutions affects the right of people with disabilities in Trujillo, 2021. In this sense, the statement of the problem of the present research work was the following: In what way does Article 36, of Law N°. 29973, on the accessibility to Educational Institutions affect the right of people with disabilities in Trujillo, 2021; against which the following specific objectives were proposed: Analyze article 36, of Law N°. 29973, on accessibility to Educational Institutions in the framework of the rights of people with disabilities, analyze the violation of the rights of people with disabilities and compare the accessibility to Educational Institutions of people with disabilities in foreign legislation. Regarding the statement of the hypothesis, it is necessary to: ““Article 36, of Law N°. 29973, on accessibility to Educational Institutions affects violating the right of people with disabilities in Trujillo - 2021““. In this sense, to carry out the analysis of the formulated problem, various logical methods have been used, including the analytical, deductive, inductive, and synthetic method; In addition to this, legal methods such as dogmatic, hermeneutical, and comparative were used. On the other hand, regarding the data collection research techniques used, there is the survey, being necessary to consider that for this the survey form was used as a research instrument. Finally, after the investigation carried out, the main conclusion was reached that article 36 on the accessibility to Educational Institutions of Law N°. 29973 affects violating the rights of people with disabilities, since the Educational Institutions analyzed (Private University Antenor Orrego, Universidad Privada del Norte, Universidad César Vallejo and the National University of Trujillo) do not provide people with disabilities with an accessible physical infrastructure, or furniture and equipment that allow “El artículo 36°, de la Ley N.º 29973, sobre la accesibilidad a las Instituciones Educativas y el derecho de las personas con discapacidad en Trujillo, 2021.” Peña Serrano, Briana del Carmen vi their educational development; In addition to this, they do not distribute educational materials that are adapted to the needs and characteristics of people with disabilities. Likewise, the second paragraph of Article 36, of Law No. 29973, refers to the learning of the braille system, sign language and other means, media and alternative communication formats that facilitate the communication of people with disabilities in Educational Institutions However, after conducting the surveys, it was concluded that the Universities mentioned in the previous paragraph do not provide people with disabilities with the communication mechanisms necessary to guarantee their communication within the University Community, as indicated in article 36 . For this, it is necessary to take into account that the Ministry of Education and regional governments are in charge of guaranteeing the accessibility of people with disabilities in Educational Institutions, however it is concluded that it would not be carrying out adequate and optimal supervision of Universities aforementioned, since as can be seen from the results obtained, the universities analyzed do not provide people with disabilities with the elements stipulated in article 36 of Law No. 29973; thus violating various rights regulated in Law No. 29973 such as the right to education, accessibility, equality and non-discrimination, life and personal integrity, as well as equal recognition as a person before the law, to the personal freedom and security, to live independently, to be included in the community, to participate in political and public life, to health and sports.
